Thank you for your interest in submitting your artist/song for contest consideration. You have two ways to send in your Press Kit submissions for this contest: 1. You can send us a Press Kit as an MP3 by e-mail to: (Click on the blue link) cdpcontest@blackmountainproductions.net (the e-mail form below must accompany the MP3) 2. or you can send a complete normal hard copy to us through the regular mail service. If you submit an MP3, please make sure that you use the "Google" buy button below to pay your submission fee. If mailing, please make your checks or money-orders payable to: "Black Mountain." Please make sure in your submission we have your complete: group bio, photos, composition(s) to be considered, entry fee and any other information needed for your material to be considered. (Submitted material will not be returned and will be retained until the close of the contest. All submission material will be destroyed by contest conclusion)

By submitting your Musical Compositions to Black Mountain Productions Inc., CD Pulse.com, you expressly warrant and represent the following to Black Mountain Productions Inc. and CD Pulse.com and acknowledge that Black Mountain Productions Inc., and CD Pulse.com, is relying upon such warranties and representations:
(1) That all factual assertions you have made and will make to us are true and complete; that you have reached the age of maturity and are otherwise competent to enter into this contest and any contracts in your jurisdiction; and that in any event you are at least 18 years of age. And I understand that all contest song submission fees are non-refundable! (A portion of the fees collected will be donated to a music charity)
(2) That you have obtained and hold all rights, approvals, consents, licenses and/or permissions, in proper legal form, necessary to submit musical compositions/press kits on the terms provided herein and to grant Black Mountain Productions Inc., CD Pulse.com, the nonexclusive licenses set forth herein.
(3) The prize winner will receive a 24 month Pre-Marketing Agreement and a 24 month Mechanical License and Mastering Agreement for the sole purpose of creating a major foundation in the music industry. Many areas of activities will be established to create the necessary promotion and marketing of your talents within the industry itself (As deemed necessary by Black Mountain Productions Inc.). Some of these areas may include (but, are not limited to): satellite, commercial and college radio airplay, the creation and sale of ringtones, wallpapers, cd singles, merchandising, creation of press kits and cd duplication packages, internet and web site inclusion and marketing, creation of performances and gigs across the USA; and additional marketing assistance through the affiliations and partners currently with Black Mountain Productions Inc., located in Canada and the UK, providing the current style and formats of the musical composition/artist fall within those current format and jurisdiction market needs and requirements. Should it be felt by the sole discretion of Black Mountain Productions Inc., that the artist is ready for the next step, Black Mountain Productions Inc., will consider establishing/offering a Standard full Management and Recording Contract with the artist and will then proceed with new negotiated terms and conditions to the benefit of all involved. Also, the prize winner will receive a 12 month eCommerce marketing and promotional package from CD Pulse.com at no additional cost or obligation.
(4) It is further understood, that Black Mountain Productions Inc.,CD Pulse.com, it's representatives, agents and/or employees, make no guarantee of your musical career success, by the acceptance of the rules of this contest, the submission of your musical compositions for review and the signing/participation with the Pre-Marketing Agreement or the Mechanical And Mastering License Agreement and eCommerce package. Black Mountain Productions Inc.,CD Pulse.com, will however, guarantee to provide to you all of the services they currently have available for all of your potential success opportunities.
(5) That no other rights, approvals, consents, licenses and/or permissions are required from any other person or entity to submit your musical compositions on the terms provided herein or to grant Black Mountain Productions Inc., CD Pulse. com, the nonexclusive licenses set forth herein.
(6) That your musical compositions are original; that your musical compositions were either created solely by you or, by written assignment, you have acquired all worldwide intellectual property rights in and to your musical compositions; that if your musical compositions contain any "samples" or excerpts from copyrightable work the rights to which are owned in whole or in part by any person or entity other than you, that you have obtained and hold all rights, approvals, consents, licenses and/or permissions, in proper legal form, necessary to use and include such work in your musical compositions; and that your musical compositions, do not otherwise infringe on the intellectual property rights of any person or entity.
(7) That you give Black Mountain Productions Inc., CD Pulse.com, your full consent to the use of your name, portraits or photographs, web sites and other materials and sources for the purposes of trade in connection with the contest.
(8) You agree to sign and deliver to Black Mountain Productions Inc., CD Pulse.com any additional documents that Black Mountain Productions Inc., CD Pulse.com may request to confirm Black Mountain Productions Inc's, CD Pulse.com rights and your warranties and representations under this Agreement.
(9) You acknowledge that Black Mountain Productions Inc., CD Pulse.com is relying upon the representations, warranties and covenants you have made herein. You agree to and hereby do indemnify Black Mountain Productions Inc., CD Pulse.com, its licensees, assigns and customers against, and hold them harmless from, any loss, expense (including reasonable attorney fees and expenses), or damage occasioned by any claim, demand, suit, recovery, or settlement arising out of any breach or alleged breach of any of the representations, warranties or covenants made herein or arising out of any failure by you to fulfill any of the representations, warranties, or covenants you have made herein.
(10) All warranties and representations made by you herein are made for the benefit of Black Mountain Productions Inc.and CD Pulse.com and its sub-licensees and may be enforced separately by Black Mountain Productions Inc. and CD Pulse. com and/or by any contractually designated sub-licensee of Black Mountain Productions Inc., CD Pulse.com. This agreement shall remain in full binding effect regardless of any activities by either party.
